用者自付 vs 擁有者付

物業維修保養費用來源可以分兩類: 用者自付 & 擁有者付
A. 用者自付
以我個人理解 DMC的各主要條文是共用地方及設施 (Common Areas & Facilities包括 Recreational and Communal Areas & Facilities – RCAF ) 的共同擁有者Owners (各大小業主包括商場業主, 幼稚園業主, 車位業主, 住宅單位業主)要根據 * Management Units (管理分數)去計算及支付維修保養費用, 這是DMC合約條文也是地政署依法審批DMC的基礎, 目的是擁有者自付以確保整體屋苑附合法例上的居住安全.

屋苑康樂設施如泳池, 網球場,,….也即是RCAF是由住宅業主們共同擁有及分擔維修保養費用的; 商場或停車位業主不會分擔的.
但使用泳池, 網球場, . . . 為何要用家每次付費使用? 其實有冇人使用RCAF設施, 住宅業主都已付出每月管理費用作設施之維護, RCAF由用家付費去享受設施而間接幫補維修保養費用, 也是DMC有明文准許如下:

(h) To charge a prescribed fee for entry into and/or use of the Recreational and Communal Areas and Facilities or any part thereof of such amount as the Manager shall in its absolute discretion deem fit provided that all such prescribed fees collected shall form part of the management fund to be utilised towards the management, maintenance and repair of the Residential Common Areas and Facilities;
當業主, 租客, 訪客, 朋友, 教練, … 使用泳池或球場時都付費, 這樣是否對全體業主公平点? 村巴又是相同一例, 但就算收費也未能收回成本.
同一論據如業主, 租客, 訪客, 朋友, 教練, 清潔工人, 菲庸, 管理處員工 …使用 Wifi 時要付費, 是否對全體業主公平点? 當然這是要考慮到管理成本, 收益及大多數業主的意願.
DMC 精神是各業主們共同承擔保養維修公用設施, 以保证 人身安全. 如要業主們補貼個別人士之 <免費康樂活動>, 大家是否同意?
B. 唔用就唔想夾錢:
夾錢的前提是: 第一我是否擁有者Owner; 第二是錢的用途是否DMC指定的維修用途,(種種康樂活動, 比賽, 餐飲, ……..等非維修性開支是否應由全部業主付? 未見DMC清楚說明; 太古城業主求禁管理公司辦活動之訴訟亦因此而起:

同一道理我不是停車位業主而只是住宅業主, 我就不付以下RCPCAF產生的所有費用包括穿梭电梯維修費, 因為駿景住宅停車场及設施由車位業主100%擁有; 根據DMC條例, 維護費只應由車位業主付.

“Residential Car Park Common Areas and Facilities” (RCPCAF) means all Residential Car Parking Areas on the ground floor and first floor of the Podium other than those specifically designated as Residential Car Parking Spaces including the guard room, water meter rooms, electrical room, fan rooms, lift lobbies, lift motor rooms, F.S. pump rooms, water tanks, driveways, general store room, control gates, and all the water pipes, drains and wires and cables and lighting in respect of the Residential Car Parking Spaces, fire fighting installation and equipment and any other facilities installed for the use and benefit of the Residential Car Parking Spaces, and includes such other areas, apparatus, devices, systems and facilities of and in the Development within the Residential Car Parking Areas as are now or may from time to time be designated by the First Owner as Residential Car Park Common Areas and Facilities;
