土審法官說Proxy Form are not binding . . .

1. 業主有權: 只授權他人代表出席業主會議 (以便達到開會法定人數); 及
2. 業主有權: 授權他人代投票。
BMO上授權書的格式將以上兩者捆绑,損害小業主之選擇權利,縱容一撮有心人制做不公投票!

26.  本席決定撤銷盧先生的申請。
27.  本席認為盧先生就2012年8月4日業主大會所用的委任代表文書的質疑毫無道理。
28.  盧先生指出所用文書與表格2不同之處,只是字眼上的差異,並不影響實質內容。《釋義及通則條例》第37(1)條訂明:
「如任何表格與由或根據條例所訂的有所差異, 只要不影響表格的內容實質,即不得因此而無效。 」
29.  再者,民政事務總署在《2007年建築物管理(修訂)條例常見問題》第156條問答有以下建議:
「問: 管委會可否在發給業主的預印委任書內,加入代表的姓名,例如管委會主席、某管委會委員或物業管理公司代表?
答: 法團提供的委託書只要符合條例附表1A所列的格式,上述做法並不會導致委託書無效。
